An innocent defendant doesn't require the same resources as a guilty one? If you don't have the financial means to afford a good lawyer, how is that going to be determined?

Over 95% of all cases end in a plea bargain.
If you think that OJ would of gotten off with a public defender, I have a bridge in NY I'd like to sell ya.
Where are you getting that 95% from?

How is what going to be determined? A defendant's innocence?

O.J. wouldn't have gotten off with a public defender because he was as guilty as sin.

The ny times, the Wall Street journal, endless other sources.

The number is actually 97% for federal cases, and 94% for state level cases.
So it could also be stated that this would be the conviction rates as well.

You're right, with a public defender OJ would have been found guilty, but regardless of his actual guilt or innocence.

The public defender would have probably tried to plead down from Capitol punishment to life without parole.
Innocent people get convicted every day

Are you going to take the deal and serve 2 years, or take your chances against a 95% conviction rate and possibly get far longer?

Re: *Update* George Zimmerman Shot at in Florida

Plea bargains are so high because of the legal blackmailing system.

You plea out, you get X amount of time. You take it to trial you not get X amount, but Y and Z equivalent stacked on top.

Plea bargains are a fear tactic that sends innocent people to prison. Especially for those who cant afford counsel. Hell, it is usually the public defenders advising their assigned clients to plea out, before they themselves even investigate the case.

It is a sad system.
