A woman calls 911 during a burglary and the 911 operator doesn't sound convinced that there really is a burglar until the husband shoots him with his .38 revolver.

A homeowner shot and wounded a suspected burglar who entered his home in Northeast Portland in June 2007.

Police say it happened at a home in the 10700 block of Northeast Glisan Street.

East precinct officers were called to the home about a possible burglary in process.

A woman inside told 911 she'd heard glass break. The dispatcher kept the woman on the line as officer raced to the scene.

Before they got there, they learned from the homeowner that one shot had been fired.

Officers got the two homeowners out of the house, then went inside to look for the reported burglar.

"They found one person down in an enclosed porch area," said Sergeant Brian Schmautz.

Matt Havlik lives around the corner on Northeast 108th Avenue. He heard a commotion, but didn't see anything.

"I heard cop sirens, a bullhorn, then a shot. And then ambulance sirens," Havlik said.

Police identified the 26-year-old burglary suspect as Brent Alexander Sweet.

Sweet suffered a single gunshot wound to the head and remains in critical condition at Legacy Emmanuel Hospital.

The homeowner who shot the suspect, Leroy Hudson, 71, is cooperating with police.

Oregon law does permit the use of deadly force if a homeowner feels a threat is imminent.

The Multnomah County District Attorney's Office declined to file any charges against Mr. Hudson but did charge Mr. Sweet, who survived, with one count of first degree criminal trespassing.
