Many people are still obsessed by a terrible accident in Thu Duc district, HCM City, in 2009.

The victim is Nguyen Thanh Trung, a police officer who was cut in two by a truck.

A video clip shot by someone shows that after the accident, Trung was still of sound mind.

He even asked witnesses to call his family but nobody helped him. He was dead after that, before an ambulance came.

The five-minute video clip was post on the internet and it roused up a wave of public protest against passers-by, who only stood to see the victim.

21/05/2012 21:59 Police of Thu Duc district will not prosecute criminal case, saying it's the victims fault entirely. However, HCM City Police Bureau of investigation has determined the errors from the dump trucks going wrong lane causing this fatal accident.

As planned, on the day of 24-5, Thu Duc District People's Court - Ho Chi Minh City will take the case to trial against the violation of regulations on drivers of road vehicles for the truck driver who killed police officer lieutenant Nguyen Thanh Trung on the Hanoi Highway in 2009, 34 months after the occurrence of the particularly serious traffic accident, the case has a chance to be investigated further.

Prosecutions has not been initiated.

Approximately at 17: 30 on the 8-8-2009, Lieutenant Nguyen Thanh Trung (a police officer of Linh Xuan Ward, Thu Duc district) was on the way home from office on a motorcycles (brand Attila), he was riding towards the "Hanoi" highway bridge, Trung was unexpectedly hit- by the driver of the dump truck Do Huu Tuan (born in 1982, native of Tuyen Quang) - from behind and rolled and dragged nearly 20 meters, segmented his body apart at hip level. However, through the video clip victim can still be seen awake, talking with people around and his hands were also constantly touching down to inspect body parts falling below. On 5-2-2010, 6 months after the death of Lieutenant Trung, Thu Duc district police sent notice to the family of victim with content: "Thu Duc district police investigation police have decided not to prosecute the criminal case number 24 dated 27-1-2010 for the following reasons:

Nguyen Thanh Trung - The victims who was riding a motorcycle while having blood alcohol level exceeding prescribed levels, having oversped and thus resulted in control error, which caused the traffic accident (violation of Article 8 and 12 Highway Traffic Act).

Too shocked by this announcement, Mr. Nguyen Thanh Phu (a veteran, victim's father ) suggested CQDT (Co quan dieu tra - investigation office) to give him the record of the crash scene examination and assessment of blood alcohol sample but he had not received any responses from the investigation office. Mr. Phu complained fiercely, until March and May 4-2010, Thu Duc district police sent a notice to add 2 further confirmed faults of the victim, did not mention any details of the truck driver. Next, Thu Duc VKSND (Public Prosecution Office) also dismissed his complaint and that "the handling of the investigative police agency of Thu Duc district police was justified".

Truck driver error:

Frustrated, Mr. Phu filed the accident video clips and complaints to various government bodies at city and national level. Ho Chi Minh City police investigators then re-assessed the accident scene and confirmed the cause of the crash that killed police lieutenant Nguyen Thanh Trung in Thu Duc district was by Do Huu Tuan, the truck driver for overloading, and going in the wrong lane. These are violations of laws prescribed in Article 202 of the Penal Code, which must be investigated, prosecuted and punished before the law.

May 3-2011, based on the proposal of the City Police investigation police agency, HCM city VKSND (Hochiminh city Public Prosecution Office) issued a decision to dismiss the decision of Thu Duc District Public Prosecution Office of not to prosecute; and requested the local police to re-investigate the traffic accident mentioned above. By May 9-2011, Thu Duc district police sent to Mr. Phu (victim's father) the announcement of the investigation results and said they had issued a decision to prosecute a criminal case, and an arrest and temporary detainment orders for 3 months for Tuan, the truck driver.

Talking to the reporters of "Workers" newspaper in his house in Binh Trung Tay Ward, District 2 - Ho Chi Minh City, Phu and his wife have had to for several times stop the story again to calm himself down, swallowing and choking and wiping tears. Phu said he himself has gone through many battles in the most intense battlefields in the Vietnam war, had witnessed many deaths of his comrades but the accident of his sons had caused terrible insomnia that led him constantly crying. The departure of the only son led his family livelihood to collapse completely. Trung dies leaving young children and his wife is currently unemployed.

"Unable to save Trung's life, I must find justice for my child. He was on the way home, on the scene he was dying wearing a police uniform, a police hat, so where did he find the time drinking alcohol to excess against the regulation? I was so shocked and very sad about the way Trung comrades in Thu Duc district police treated him! "- Mr. Phu stated in frustration.

The case will be brought to trial. However, since the contents of discrepancies of the results between the police of Thu Duc police district and HCM City Police investigations shows that there are too many irregularities in the investigation of this case.
